How to Look Up a Court Case in York County?

Are Court Records Public in York County?
Court records in York County are presumptively open to the public. Two key legal frameworks govern access.
The Rules of the Supreme Court of Virginia, Part Eleven, establish the general right of public access to judicial records. These rules apply to all courts in the Commonwealth, including York County’s Circuit Court, General District Court, and Juvenile and Domestic Relations Court. Additionally, the Virginia Public Records Act provides a broader framework for access to government records. Despite this presumption of openness, certain categories of records are restricted or sealed from public view. Records that are not publicly accessible include:
- Juvenile court records
- Adoption case files
- Records sealed by court order
- Materials subject to attorney-client privilege
- Medical, psychiatric, and psychological reports submitted to the court
- Records exempted by specific federal or state statutes
At the York County-Poquoson Circuit Court, cases involving Juvenile and Domestic Relations Court appeals and other sealed matters are not available for public inspection. Only counsel of record or parties to the case may review these files, and identification may be required. Adoption records cannot be inspected by any individual absent a specific court order granting access. OCRA also excludes juvenile, adoption, and sealed cases and documents from its online system.
York County Criminal Court Records

Virginia State Police Criminal Background Checks
The Virginia State Police (VSP) serves as the Commonwealth’s central repository for criminal history records. Under VA Code § 19.2-389.1, the VSP makes conviction information available to qualified requesters. York County Civil Court Records
Civil disputes in York County are heard by both the Circuit Court and the General District Court. The Circuit Court handles all civil cases with claims exceeding $25,000 and shares jurisdiction with the General District Court over claims between $4,500 and $25,000. Claims of $4,500 or less fall within the exclusive original jurisdiction of the General District Court. York County Family Court Records
Family law matters in York County are divided between the Circuit Court and the Juvenile and Domestic Relations (J&DR) District Court. Divorce, annulment, and property distribution cases are handled by the Circuit Court, while the J&DR Court addresses custody and visitation disputes, child support enforcement, protective orders, juvenile delinquency proceedings, and cases involving children in need of services.
Divorce Proceedings
Divorce cases are filed with the York County-Poquoson Circuit Court. Virginia law requires that at least one spouse be a resident of the Commonwealth for a minimum of six months before filing, per Virginia Code § 20-97. For couples without children, a six-month separation period plus a written property settlement agreement is required before filing. Couples with children must be separated for at least one year under Virginia Code § 20-91.
The filing fee for a divorce action is $84.00. Service fees of $12.00 per person or document apply when served by a Sheriff of the Commonwealth. Private process servers may be used as an alternative.

Juvenile and Domestic Relations Court

Marriage Records
The Clerk of the Circuit Court issues marriage licenses and maintains marriage records. The license fee is $30.00, payable by check (to York County–Poquoson Circuit Court), Visa, or MasterCard (with a convenience fee of 4% or $2.00, whichever is greater). After the officiant returns the signed certificate, certified copies may be obtained from the Clerk’s Office at $2.50 each.
Under VA Code § 32.1-271, marriage records remain confidential for 25 years after recordation, after which they become public. During the confidentiality period, certified copies are available only to parties named on the certificate and their immediate family members (mother, father, spouse, child, brother, sister, or grandparent).
Marriage records are also available through the Secure Remote Access system, with digital records dating back to 1866. The Virginia Department of Health Office of Vital Records offers an alternative avenue through its online vital records application, at a cost of $12.00 per certificate.
Birth and Death Records
York County birth and death records are maintained by the Virginia Department of Health (VDH) Office of Vital Records. Under VA Code § 32.1-271, birth records are confidential for 100 years and death records for 25 years. During the confidentiality period, only the registrant and immediate family members are eligible to receive copies. Requests can be made in person at the VDH Office of Vital Records (2001 Maywill Street, Suite 101, Richmond, VA 23230; walk-in hours Monday–Friday, 7:00 a.m.–4:30 p.m.), by mail, or online. Each certificate request costs $12.00, and requesters must provide valid identification.
York County Probate Court Records
Probate matters in York County are handled by the Circuit Court. The Clerk of the Circuit Court has the statutory authority to probate wills, qualify executors and administrators, grant administration of estates, and appoint guardians. If a resident of York County or the City of Poquoson dies, the will should be probated through the York County-Poquoson Circuit Court Clerk’s Office.
Starting the Probate Process
An appointment with the Clerk or a deputy clerk is required to probate a will or qualify as an administrator or executor. Appointments can be scheduled by calling the Wills and Estates line at (757) 890-4106. At the appointment, the following items should be available:
- The original will (if one exists)
- An official death certificate
- Names, addresses, and ages of all heirs-at-law
- The approximate value of assets owned by the decedent
A state probate tax of $1.00 per $1,000 of estate value is payable at the time of filing. York County and the City of Poquoson do not impose a local probate tax. Recording fees also apply and depend on the number of pages in the recorded instruments. Under Virginia’s fee schedule:

Qualification fees are based on estate value: no fee for estates valued at $5,000 or less, $20.00 for estates up to $50,000, $25.00 for estates under $100,000, and $30.00 for estates of $100,000 or more.
After Qualification
Once an executor or administrator is qualified, reports must be filed with the Commissioner of Accounts for York County and the City of Poquoson.
