Spotsylvania County is located in central Virginia, roughly between Fredericksburg and Richmond, and is part of the 15th Judicial Circuit and the 15th Judicial District. The county operates three courts that together cover criminal, civil, family, juvenile, probate, and traffic matters. All three courthouses sit on the same judicial campus in the town of Spotsylvania. The Clerk of the Circuit Court — currently Christalyn M. Jett, serving since 2008 — functions as the official custodian of most court records, land records, probate filings, and vital-records services within the county.
For those searching Virginia court records, several resources are available. In addition to visiting the local clerk’s office or using public-access terminals at the courthouse, members of the public can consult online case information systems maintained by the state judiciary. VirginiaStateCourts.us can help users find publicly available court case data across the Commonwealth. The Virginia court system also provides dedicated online lookup tools for circuit, general district, and juvenile courts that allow searches by party name, case number, and hearing date at no charge.

Are Court Records Public in Spotsylvania County?
Virginia follows a strong presumption of openness for court records. Under the Virginia Freedom of Information Act (FOIA), codified in Va. Code §§ 2.2-3700 through 2.2-3714, government records are generally available for public inspection and copying. Record custodians may charge reasonable fees to cover the cost of reproducing documents. Requesters are not required to state the reason for their request.
Despite this broad presumption of access, certain categories of Spotsylvania County court records are restricted or wholly exempt from public disclosure:
- Sealed court records (by judicial order)
- Criminal records where the defendant was acquitted or charges were dismissed, in certain circumstances
- Personal identifying information about minors
- Social Security numbers, financial account details, and other sensitive personal data
- Records pertaining to ongoing law-enforcement investigations that could compromise the case
- Mental health commitment proceedings
- Adoption files
- Custody evaluations and related confidential family court documents
- Information that could endanger a witness, law-enforcement officer, or other individual
Classified information is redacted from any public copy. Non-public records remain accessible only to the parties to the case, their attorneys, authorized court officers, law-enforcement agencies, and specially authorized third parties with a demonstrated interest. If you are uncertain whether a particular record is public, contact the Clerk of the Circuit Court at (540) 507-7600.

Spotsylvania County Probate Court Records
Probate and estate-administration matters in Spotsylvania County fall under the jurisdiction of the Circuit Court. The Clerk of the Circuit Court acts as a probate judge, responsible for authenticating wills, conducting probate hearings, appointing executors or administrators, qualifying guardians for minors and incapacitated adults, and preparing related court orders.
Starting the Probate Process
Jurisdiction is based on the decedent’s county of residence at the time of death. To initiate probate, complete a Probate Application and submit it along with the original will (if one exists) and the death certificate. Applications may be submitted by email, mail, or in person. The Clerk’s office does not accept photocopies of wills — only the original document.
Probate appointments are scheduled in the order applications are received. Contact the Clerk’s office at (540) 507-7603 or (540) 507-7620 for questions, especially if the decedent owned real estate in Spotsylvania but resided elsewhere.
Types of Estates
- Testate estates — The decedent left a valid will.
- Intestate estates — No will was left; distribution follows Virginia’s intestacy statutes.
- Small estates — Personal property (excluding real estate) valued at less than $75,000, which may qualify for a simplified administration process.
