Are Court Records Public in Prince William County?

Obtaining Criminal Record Copies

Copies of criminal case documents from the Circuit Court can be requested by completing the Court Case Copy Request Form and submitting it to Room 310 (Criminal Matters) at the Judicial Center. Agencies requesting certified copies of criminal records should email 2ndDistrictCourtRecords@courts.state.mn.us — or more accurately, email circuitcourt@pwcgov.org — and allow up to five business days for processing.

Criminal History Background Checks

Criminal history records are not public under Va. Code § 19.2-389 and are accessible only to the record subject, individuals authorized by the subject, and certain employers and agencies with a lawful purpose. The Virginia State Police serves as the statewide repository for criminal history records.

For a local background check, the Prince William County Police Department performs checks for county residents and individuals with a local arrest record. The process requires:

  • Two valid forms of identification (one photo ID showing date of birth)
  • Acceptable IDs: valid driver’s license, DMV-issued ID card, passport, Social Security card, birth certificate, or military ID

Mail requests must include a notarized authorization letter, photocopies of two valid IDs, a $6.00 money order payable to “PWC Director of Finance”, and a self-addressed stamped envelope.

Arrest Records

The Prince William County Police Department publishes arrest information and maintains incident reports. Local agencies such as the Manassas Park Police Department and the Manassas City Police Department also process local record checks within their jurisdictions. Prince William County Civil Court Records

Civil litigation in Prince William County is distributed between the Circuit Court and the General District Court based on the amount in controversy. Land and Property Records

The Circuit Court Clerk serves as the recorder of deeds, plats, and related land records for Prince William County. These records can be searched online through the Records for Occasional Users system, which provides access to deeds from January 1918 to present, plats from 1918 to present, judgments from January 1988 to present, and fiduciary records (wills, probate, list of heirs) from January 1981 to present. Prince William County Family Court Records

Family law matters in Prince William County are divided between two courts. The Juvenile and Domestic Relations Court (JDR Court) handles paternity, child support, custody, visitation, protective orders, and most domestic relations cases. Accessing Family Court Records

Because JDR Court records frequently involve minors and sensitive domestic matters, public access is significantly restricted under Virginia FOIA and Va. Code § 16.1-305. JDR case records are generally not available online. Access is limited to parties to the case, their attorneys, and individuals or agencies authorized by statute or court order. Virginia law keeps marriage and divorce records confidential for 25 years from the date of the event. During that period, access is restricted to the record subjects, immediate family members, and legal representatives.

Birth and Death Records

Birth certificates are confidential for 100 years, and death records for 25 years, under Virginia law. Eligible requesters—including the record subject, immediate family, legal guardians, and authorized agencies—may obtain these records from the Office of Vital Records using the same application process and $12.00 fee described above. The Circuit Court Clerk’s Office does hold some historic birth and death records of genealogical value, but current vital records must be obtained through the state.

Prince William County Probate Court Records

The Prince William County Circuit Court serves as the court of probate, handling the qualification of wills, estate administration, trust matters, and the appointment of guardians and conservators for incapacitated adults. All probate-related filings are managed by the Clerk of Circuit Court.
