Are Court Records Public in Prince George County?
Virginia law extends broad public access to court records. The Virginia Freedom of Information Act, codified at Virginia Code § 2.2-3700 et seq., affirms that citizens of the Commonwealth are entitled to access public records held by government bodies. Court case records, however, are governed specifically by Titles 16.1 and 17.1 of the Virginia Code and by the Rules of the Supreme Court of Virginia rather than by VFOIA directly. Under these provisions, most court records are open for public inspection at the appropriate clerk’s office during regular business hours.
Certain categories of records are restricted from public disclosure:
- Juvenile case files — Confidential under Virginia Code § 16.1-305; generally accessible only to specifically authorized parties. Records involving juveniles charged with offenses that would constitute felonies if committed by adults may be subject to partial disclosure.
- Adoption records — Sealed by statute and not available for general inspection.
- Mental health and competency records — Psychiatric evaluations and involuntary commitment proceedings are protected.
- Attorney-client privileged communications — Exempt from disclosure where applicable.
- Active law enforcement investigative materials — Withheld when disclosure would compromise an ongoing investigation.
- Sealed and expunged records — Removed from public access by court order.
- Proprietary business information — Protected from compelled disclosure.
Members of the public may review unrestricted records in person at the clerk’s office. The county also accepts FOIA requests for government records through its FOIA Officer:
