Mecklenburg County, Virginia, is a rural county in the southern part of the state, with Boydton serving as the county seat. The county’s judicial system comprises three distinct courts — the Circuit Court, the General District Court, and the Juvenile and Domestic Relations District Court — each with its own jurisdiction, docket schedules, and records maintained by designated clerks. Court records generated by these courts document the full range of legal proceedings in the county, including criminal prosecutions, civil disputes, family law matters, and probate filings.

Are Court Records Public in Mecklenburg County?

Most court records in Mecklenburg County are public under the Virginia Freedom of Information Act (VFOIA), which establishes a broad presumption that all public records shall be open for inspection and copying. The Act states that any exemption from public access shall be narrowly construed, and no record shall be withheld unless a specific statutory exemption clearly applies.

Despite this presumption, Virginia law identifies several categories of court records that are withheld from general public access:

  • Sealed court records — any record sealed by judicial order is not available for inspection
  • Juvenile records — cases involving minors in delinquency, abuse, or neglect proceedings are confidential
  • Adoption records — sealed by statute; access requires a court order or proof of good cause
  • Mental health records — confidential under state law
  • Hospital and medical records — protected from general disclosure
  • Foster care home placement records — exempt from public release

Where a record contains both exempt and non-exempt material, custodians are expected to provide the non-exempt portions after redacting the protected content. Written requests for court records submitted to the Circuit Court Clerk’s office are the standard mechanism for accessing documents not available through online portals. Requests should include the case name, case number, attorney number, and any other identifying details to facilitate the search.

Mecklenburg County Criminal Court Records

Criminal proceedings in Mecklenburg County follow a two-tier structure. The Mecklenburg County General District Court handles misdemeanor criminal offenses — those carrying lesser penalties — as well as traffic violations and preliminary hearings for felony cases. If a felony charge survives the preliminary hearing at the General District Court level, the case is transferred to the Circuit Court for arraignment and trial.

The Mecklenburg County Circuit Court has exclusive jurisdiction over felony cases and the authority to hear appeals from the General District Court. Circuit Court terms begin on the third Monday of each month from January through November, and on the second Monday in December. Grand juries convene on the first day of each term, with court generally starting at 9:30 a.m. All criminal cases must be coordinated with the Commonwealth’s Attorney’s Office.

Criminal case information is searchable through the OCIS statewide case search and the General District Court Online Case Information System. Both systems allow searches by name, case number, or hearing date.

For arrest records not connected to a court filing, inquiries should be directed to the Mecklenburg County Sheriff’s Office. Expunged criminal records are sealed and not available through any public access channel. Mecklenburg County is served by the Piedmont Court Services unit, which operates under the county and provides pretrial and local probation services.

Mecklenburg County Civil Court Records

Civil jurisdiction in Mecklenburg County is divided between two courts based on the monetary amount in dispute. The Mecklenburg County Circuit Court has exclusive jurisdiction over civil claims exceeding $25,000 and shares concurrent jurisdiction with the General District Court for claims between $4,500 and $25,000. The General District Court handles civil matters up to $50,000 — a limit raised under recent Virginia legislation — and operates a Small Claims Division for disputes up to $5,000 under Virginia Code Title 16.1, Article 5.

Circuit Court terms for civil matters convene on the schedule described above. All civil cases are scheduled through the Circuit Court’s administration by email at pcolgate@courts.state.va.us. Commissioners in Chancery are utilized in appropriate civil matters, and jury instructions must be submitted at least 10 days before trial.

To request civil case records from the Circuit Court Clerk:

  1. Prepare a written request identifying the case name, case number, attorney of record if known, and the specific documents requested.
  2. Submit the request in person during office hours (Monday–Friday, 8:30 a.m.–5:00 p.m.) or by mail to P.O. Box 530, Boydton, VA 23917.

The Mecklenburg County Juvenile and Domestic Relations (JDR) District Court is the primary forum for custody, support, visitation, family abuse, child abuse and neglect cases, and criminal matters where the defendant and alleged victim are family or household members. The Mecklenburg County Circuit Court handles divorce, annulment, and adoption proceedings.

JDR Court Schedule:

  • All Juvenile and Domestic Relations matters: Every Wednesday and Thursday at 9:00 a.m.

The Circuit Court maintains marriage records and issuance of concealed handgun permits and notary public certificates as part of its administrative functions. Certified marriage certificates are also available through the Virginia Department of Health using the same application form and fee as divorce certificates.

Access to marriage records is restricted to the couple, their parents, adult children, adult siblings, or a legal representative with documented proof of relationship.

Birth and Death Records

Birth and death records are not held by the county courts. Certified copies are available exclusively through the Virginia Department of Health Office of Vital Records. Eligible requesters for birth records include the record holder and their immediate family — parents, spouse, grandparents, legal guardian, and legal representatives. Death certificate copies are limited to the deceased’s immediate family; other parties may request a Verification of Death with a demonstrated legitimate interest.

Mecklenburg County Probate Court Records

Probate jurisdiction in Mecklenburg County rests primarily with the Circuit Court, which oversees the probate of wills, administration of decedents’ estates, guardianships, conservatorships, adoptions, and name changes. The Juvenile and Domestic Relations District Court has a more limited role, handling certain name change matters. For the full scope of estate and probate proceedings, the Circuit Court is the authoritative forum.

The Circuit Court Clerk’s office maintains all probate case files and related filings. These records are generally public unless sealed or restricted by court order. The clerk’s office also records and maintains deeds and other land records — making it the repository for a range of documents that may be relevant to estate proceedings.

Probate case information entered into the Circuit Court’s case management system is searchable through the Virginia Circuit Courts Case Management System (CJIS). The Virginia Court System also provides Secure Remote Access (SRA) to public land records — including wills and deeds recorded by clerks of court under Virginia Code § 17.1-294 — available by subscription through individual circuit court clerks.
