Are Court Records Public in Lynchburg City?
Public access to Lynchburg court records is governed by Part Eleven of the Rules of the Supreme Court of Virginia, which sets the framework for public access to judicial branch records. Lynchburg City Criminal Court Records

Searching Criminal Case Records

Circuit Court searches return defendant details, charge information, arrest and offense dates, hearing events, final disposition, and sentencing or incarceration information. A $10 search and service fee is required, payable by cash, credit card, money order, or check made out to the Lynchburg City Police Department. Card payments carry a 2.25% transaction fee. Requests can be made in person or by mail using the department's Incident Request Form, accompanied by a stamped self-addressed envelope. Allow five days after the report date before checking on release status.

Criminal Background Checks
The Lynchburg Police Department no longer offers criminal background checks as of June 2017. For criminal history record checks in Virginia, use the Virginia State Police Central Criminal Records Exchange. The process involves completing Form SP-167 for eligible parties under Va. Code 19.2-389 (which requires a notarized signature), or Form SP-230 for healthcare and childcare agencies screening employees.

Expungement
Expungement petitions are filed with the Lynchburg Circuit Court. The filing fee is $98, payable by check, cash, or money order to Lynchburg Circuit Court. The petition must include personal information, all charges to be expunged, case numbers, dates, and certified copies of warrants or indictments showing final disposition. An Expungement Packet is available from the court. The process typically takes three to six months. Expungement is governed by Virginia Code 19.2-392.2.
Lynchburg City Civil Court Records
Civil litigation in Lynchburg is divided between the Circuit Court and the General District Court based on the amount in controversy. The Circuit Court has exclusive jurisdiction over civil cases exceeding $25,000 and shares jurisdiction with the General District Court for claims between $4,500 and $25,000. The General District Court has exclusive authority over claims below $4,500, and its small claims division handles cases seeking up to $5,000.

Copy Fees and Filing
Copies of land records and other documents in the Circuit Court Clerk's Public Records Room cost $0.50 per page. Effective June 1, 2026, a $5.00 filing fee applies to paper submissions under Virginia Code 17.1-258.3. No fees are assessed for indigent cases under 19.2-159.

Property and Land Records
Land records dating from 1805 to the present are housed in the Circuit Court Clerk's Office. The public may view these records in the Public Records Room and obtain copies at $0.50 per page. Recordings are accepted between 8:30 AM and 4:15 PM.
For remote access, the Secure Remote Access (SRA) portal provides subscription-based online access to land records maintained under Virginia Code 17.1-294. Subscription fees for the Lynchburg Circuit Court are $50 per month, $270 per six months, or $480 per year. Lynchburg City Family Court Records
Family law cases in Lynchburg are divided between the Circuit Court—which handles divorce, equitable distribution, and annulment—and the Juvenile and Domestic Relations District Court, which covers custody, visitation, support, crimes involving family members, child abuse and neglect, and juvenile delinquency.
Divorce Records
Divorce proceedings are filed in the Lynchburg Circuit Court. The filing fee is $86, with service fees of $12 per person per document served. The court's website provides several resources for self-represented parties, including the Virginia State Bar's Guide to Divorce in Virginia, Virginia Legal Aid self-help forms, and a Petition for Proceeding in a No-Fault Divorce Without Fees or Costs for those who qualify.
Divorce certificates—documents confirming that a divorce occurred—are available through the Virginia Department of Health's Division of Vital Records. The fee is $12 per certified copy or search. Divorce records become public 25 years after the event.
Marriage Licenses and Certificates
Marriage licenses are issued by the Lynchburg Circuit Court Clerk's Office. Both applicants must appear in person with valid identification, and appointments are encouraged. The fee is $32.50 (cash, check, or money order), which includes one certified copy; an additional $2 convenience fee applies for card payments. The license is valid for 60 days and must be used in Virginia. Certified copies of previously issued marriage licenses cost $2.50.

Juvenile and Domestic Relations Court
The JDR Court handles criminal matters involving persons under 18, child custody and visitation, child and spousal support, family violence protective orders, child abuse and neglect, and paternity determinations. Protective order recipients may apply for a Hope Card—a wallet-sized card containing essential information about their civil protective order—issued for orders with a duration of 12 months or longer.
Birth and Death Records
Birth and death certificates are vital records maintained by the Virginia Department of Health, Office of Vital Records. Eligible applicants—the record subject, immediate family members, or legal guardians—may request certified copies by mail, in person, online, or through an express third-party vendor.

Fees are $12 per certified copy or search. Express delivery through the authorized third-party vendor costs $20.80 per certificate plus a nonrefundable $11.95 service fee. Birth records become public 100 years after the event. Death records become public 25 years after the event.
Lynchburg City Probate Court Records
Under Virginia Code 64.2-443, circuit courts have jurisdiction over the probate of wills. The Lynchburg Circuit Court's Probate Division handles estate administration for deceased Lynchburg residents—whether they left a will (testate) or died without one (intestate)—as well as guardianship and conservatorship filings.

Recording of Real Estate Affidavits and Lists of Heirs is handled through the Probate Division, and these fees include recording in the land records.
Guardianship and Conservatorship
A petition for guardianship or guardianship and conservatorship is filed in the Civil Division for $20 and must include a completed affidavit with state-required information about the incapacitated person. The Guardianship Addendum Form should accompany the petition. After the civil proceeding concludes, the guardian or conservator must qualify in the Probate Division.
Estate Administration
Once an executor or administrator is appointed by the court, they are responsible for inventorying assets, paying debts and taxes, and distributing the estate according to the will or Virginia's intestacy statutes. The Lynchburg Circuit Court staff cannot provide legal advice regarding estate matters but will assist with procedural questions.
