How to Look Up a Court Case in Loudoun County?
Searching for a court case in Loudoun County can be done online, in person, or by mail. The method you choose will depend on which court handled the case and whether you need certified copies or simply want to view a record.
Online Search
- Visit the Online Case Information System (OCIS 2.0) for Circuit Court cases. Select “Loudoun” from the locality dropdown to narrow results.
- For General District Court cases, use the General District Court Case Information System and select Loudoun County.
- Search by party name, case number, or hearing date. Online searching is free; however, the systems display case information only and do not provide downloadable document copies.
In-Person Search
- Public-access kiosks are located on the third and fourth floors of the courthouse complex at 18 East Market Street in Leesburg. These terminals allow you to view scanned case documents and print copies for a fee.
- You may also request records directly at the clerk’s office window in the relevant court.
Mail Request

Under VA Code § 17.1-275, these fees are set by statute. Payments accepted in person include cash, check, money order, and credit or debit card (a convenience fee of 4% or $2, whichever is greater, applies to card payments). Parties to a case are entitled to one free certified copy of a final decree or order, but must provide a self-addressed stamped envelope to receive it by mail.
Are Court Records Public in Loudoun County?
Court records in Loudoun County are presumptively open to the public. Two primary bodies of law govern access: Title 17.1 of the Code of Virginia, which addresses courts of record (including the Circuit Court), and Title 16.1, which covers district courts.
Under VA Code § 17.1-208, records maintained by circuit court clerks must be open to inspection in the clerk’s office by any person. Members of the public may examine and copy these records during regular business hours. The Virginia Freedom of Information Act (FOIA) provides an additional framework for requesting records held by public bodies, including the Sheriff’s Office and county agencies.
Certain categories of records, however, are not available for public inspection:
- Sealed records — A judge may order case files sealed for reasons specified by statute or court order.
- Adoption records — Under VA Code § 63.2-1245, adoption case files are confidential and available only to attorneys of record, social services offices, and court officials. Any other person must petition the court in writing and receive a judge’s ruling before copies can be released.
- Mental health records — Files relating to civil commitment or other mental health proceedings are generally not subject to public disclosure.
- Juvenile records — Most proceedings in the Juvenile and Domestic Relations District Court are confidential by statute.
- Records protected by attorney-client privilege or other statutory exemptions under VA Code § 2.2-3705.1 et seq.
If a records request is denied, the custodian must cite the specific statutory exemption. Requesters may seek a ruling from the court if they believe a denial was improper.
Loudoun County Criminal Court Records
Criminal cases in Loudoun County are divided between the Circuit Court and the General District Court based on severity. The Circuit Court has jurisdiction over felony trials and appeals from the lower court, while the General District Court handles misdemeanors and conducts preliminary hearings in felony cases. Searching Criminal Case Records
- Use OCIS 2.0 for Circuit Court criminal cases or the General District Court online system for misdemeanor and traffic cases. Both systems allow searches by defendant name, case number, or hearing date.
- Visit the courthouse to use public kiosks on the third or fourth floor. Under VA Code § 16.1-69.48:2, the General District Court clerk cannot charge more than $1.00 for the first two pages and $0.50 for each additional page.
- Mail a completed copy request form with applicable fees to the relevant clerk’s office.
Sheriff’s Office Records
The Loudoun County Sheriff’s Office maintains arrest records, accident reports, and incident summaries independently of the courts. Records requests must be submitted through the Sheriff’s Office online portal or by email to SHERIFFS_RECORDS_SECTION@Loudoun.gov.
- Accident report copies — Available to individuals listed on the report and their insurance companies. A $10 fee applies for businesses and out-of-county residents. How to Request Civil Records
- Email — Complete the Copy Request Form (PDF) and send it to the Civil Division by email. You will receive an invoice; copies are emailed after payment is confirmed. Requests received after 3:00 p.m. are processed the next business day.
- Mail — Send the completed Copy Request Form with a check or money order and a self-addressed stamped envelope to the mailing address above.
- In person — Visit the third-floor Civil Division window in the courthouse. Case files that are not sealed can also be viewed on public computers located on the third and fourth floors, with printouts paid at the counter.
Certified and triple seal copies must be requested in person or by mail; they cannot be processed via email.
Circuit Court Civil Filing Fees
Filing fees in the Circuit Court are calculated in accordance with various sections of the Code of Virginia. A few commonly referenced fees include a $31 reinstatement fee for closed cases and service fees of $12 per party via sheriff or $5 per party via private process for a subpoena duces tecum. General District Court Civil Cases

Loudoun County Family Court Records
Loudoun County does not operate a standalone family court. Family law matters are instead divided between two courts based on the type of case.
Circuit Court — Exercises exclusive original jurisdiction over divorce, annulment, equitable distribution of marital assets, and property settlement agreements. When child custody, visitation, or support issues are part of an active or closed divorce case, those matters typically remain in Circuit Court unless an order remands them to the JDR Court.

Filing Fees in JDR Court
Under VA Code § 16.1-69.48:5, the following fees apply to domestic relations petitions:
- Custody or visitation petition: $25 (only one fee is required when a single petitioner files custody and visitation petitions simultaneously)
- Service fee via Sheriff (Virginia addresses): $12 per party
Searching Family Court Records
Family case information is accessible through OCIS 2.0 by selecting the appropriate Loudoun County court from the dropdown menu. Be aware that many JDR proceedings involving juveniles or domestic violence protective orders are confidential and will not appear in public search results.
Marriage Records
The Clerk of the Circuit Court issues marriage licenses in Loudoun County. The Public Services Division offers both in-person and virtual appointments for marriage license applications; appointments can be scheduled online. Certified copies of marriage and divorce certificates are available through the Virginia Department of Health — Division of Vital Records. To request a certified copy online, applicants must complete the application form, upload acceptable identification, and pay a $12.00 per-copy fee by credit card. Standard processing by mail takes approximately 20 days; expedited processing and walk-in locations are also available for same-day service.
Marriage and divorce records are classified as vital records and are restricted to the registrants, their immediate family members, and authorized legal representatives who provide proof of their relationship and purpose for the request.
Loudoun County Probate Court Records
Probate matters in Loudoun County are handled by the Clerk of the Circuit Court, who has statutory authority under the Code of Virginia to probate wills, appoint and qualify executors and administrators, qualify conservators and guardians for incapacitated adults, and appoint guardians for minors’ persons and estates. No person may act as executor, administrator, testamentary trustee, conservator, or guardian until formally appointed by the judge or clerk and qualified before the clerk.

Probate appointments can be scheduled online. Walk-in service is not available for probate matters, unlike other divisions of the Clerk’s Office.
Types of Probate Records
The Probate Division maintains records including admitted wills, letters testamentary, letters of administration, inventories, accountings, fiduciary bonds, guardianship and conservatorship filings, and related court orders.
Searching Probate Records
- Records from July 1, 1995, to the present are available on public-access computers on the second floor of the Clerk’s Office and through the Clerk’s online land records remote access subscription system, which also indexes probate documents.
- Historical probate records dating back to 1757, when Loudoun County was formed, are held in the Archives Department of the Clerk’s Office.
- A $5.00 fee applies to estate research inquiries. Requests must be made in writing with payment included — the Clerk’s Office does not conduct estate research by telephone or email.
Probate Filing Fees
Probate-related fees are governed by several Virginia Code sections. Key fees from the statewide Circuit Court fee schedule include:
- Qualification fee (oath, initial bond, two certificates of qualification, and order of qualification): ranges from $0 for estates valued at $5,000 or less, to $20 for estates up to $50,000, $25 for estates under $100,000, and $30 for estates over $100,000 (per VA Code § 17.1-275(A)(3))
- Additional certificates of qualification: $2.00 each
- Lodging a will for safekeeping: $5.00
