How to Look Up a Court Case in Gloucester County?
Identifying the right court is the essential first step in locating a Gloucester County case record. The Circuit Court handles felonies, civil matters over $4,500, domestic relations cases, and probate; the General District Court covers misdemeanors, traffic offenses, and civil claims under $25,000; and the Juvenile & Domestic Relations District Court handles matters involving juveniles, family abuse, child support, custody, and visitation.

Records not available online — including older files, certified copies, and confidential case materials available only to qualified parties — can be requested directly at the respective clerk’s office. The Circuit Court Clerk’s public records room operates specific hours for walk-in access, and records may also be requested by mail with a self-addressed stamped envelope and applicable fees.

Are Court Records Public in Gloucester County?
The public right of access to court records in Gloucester County is grounded in Title 16.1 and Title 17.1 of the Code of Virginia, which collectively govern the creation, maintenance, and disclosure of all court records in the Commonwealth. Under these statutes, any person may request to inspect or copy a court record unless the record is exempt by statute or court order.
The following categories of records are confidential and not open to the general public:
- Juvenile case files — Confidentiality of records in juvenile cases must be maintained at all times; the Juvenile & Domestic Relations District Court is prohibited from disclosing juvenile case information by telephone

Gloucester County Criminal Court Records
Criminal matters in Gloucester County are handled at two levels. The Circuit Court has exclusive jurisdiction over felonies and misdemeanors initiated by grand jury indictment or appealed from the General District Court, as well as transfer and certification of juvenile felony offenses. The General District Court handles misdemeanors originating in that court, traffic infractions, and preliminary hearings for felony charges before binding them over to the Circuit Court.

Criminal records from both courts are searchable online through the Virginia Judiciary’s Case Status and Information databases. For Circuit Court criminal cases, the CJIS system allows searches by name, case number, or hearing date. District Court criminal and traffic records are available through the General District Court Online Case Information System.
Requesting Copies
Copies of criminal case records are obtained from the clerk’s office of the court that heard the case. The Circuit Court Clerk’s public records room is open Monday through Friday, 8:00 a.m. to 4:15 p.m. (receipting ends at 4:00 p.m.). Copies are available for $0.50 per page, with a $2.00 per document certification fee for certified copies.
Criminal History Records
Court case records document the proceedings of a specific case — they are distinct from criminal history records. A comprehensive criminal background check covering multi-jurisdictional arrest and conviction data is available through the Virginia State Police Criminal History Record Check, which is the Commonwealth’s central repository for such information. Requests for criminal history records should be directed to the VSP rather than the court clerk’s office.
For public records held by the Gloucester County Sheriff’s Office, requests can be submitted under the Freedom of Information Act through the Gloucester County FOIA process.
Gloucester County Civil Court Records
Civil litigation in Gloucester County is divided between two trial courts based on the amount in controversy:
- Circuit Court has exclusive jurisdiction over civil claims exceeding $25,000, as well as all domestic relations matters including divorce and annulment
- General District Court handles civil claims up to $25,000, with concurrent jurisdiction alongside the Circuit Court for claims between $4,500 and $25,000
Filing a Civil Case in Circuit Court
Civil filings in the Circuit Court require a cover sheet (form CC-1416) for all civil actions. Filing fees vary by case type and are calculated through the Supreme Court of Virginia’s civil filing fee calculation system. Because the civil fee schedule changes frequently, the Circuit Court Clerk’s office recommends contacting the civil division directly for specific fee information before filing.
All monetary transactions at the Circuit Court must be completed by 4:15 p.m. The Circuit Court does not provide standardized pleading forms for civil suits, and pro se parties are strongly encouraged to consult an attorney before filing an action.
Searching Civil Records Online
Civil case records filed in the Circuit Court are searchable through the CJIS system. Civil cases in the General District Court are searchable through the General District Court Online Case Information System. Both tools allow searches by party name, case number, or hearing date. Confidential records cannot be retrieved through these public-facing systems.
In-Person Records Access
The Circuit Court Clerk’s public records room at Suite 327 is open Monday through Friday, 8:00 a.m. to 4:15 p.m. Land records, including deeds, deeds of trust, and property-related documents recorded since 1859, are also maintained by the Circuit Court Clerk and available for inspection in the records room. Copies cost $0.50 per page; certified copies carry an additional $2.00 per document fee. Online property information is also accessible through the Gloucester Citizen Central Portal at no charge.
Gloucester County Family Court Records
Family-related legal matters in Gloucester County are distributed between two courts depending on the specific issue and how the case originates.
Circuit Court handles all divorce and annulment proceedings exclusively, as well as child support, custody, and visitation matters that originate there or are appealed from the JDR Court. Juvenile & Domestic Relations (JDR) District Court handles family abuse cases, matters involving adult defendants where the victim is a family or household member, and child support, custody, and visitation matters that originate in that court.

The JDR Court’s clerk’s office serves the citizens of Gloucester, Mathews, and Middlesex counties. Juvenile case records are strictly confidential — the JDR Court is prohibited from disclosing juvenile case information over the telephone, and these records are not accessible through public online systems.
Divorce Records
All divorce (dissolution of marriage) cases are filed in and maintained by the Circuit Court. To file a divorce complaint, the filing fee is $82. If service on a Virginia-resident defendant by the Sheriff is requested, an additional $12 service fee is required along with two extra copies of the complaint. If the wife wishes to resume her maiden name in the final decree, an additional fee of $26 applies. Virginia requires either a six-month separation period (no children, with a written property settlement agreement) or a one-year separation (with minor children) before a divorce can be finalized.
Marriage Records
Marriage licenses are issued and recorded by the Gloucester County Circuit Court Clerk’s Office. The Clerk issues a certified copy of the marriage license to each couple at no charge at the time of issuance. Subsequent certified copies for the couple — and copies requested by other members of the public — cost $2.50 per copy under Va. Code Ann. § 32.1-267. Mail requests require the spouses’ full names, date and place of marriage, and a self-addressed stamped envelope.
Birth and Death Records
Vital records in Virginia are managed at the state level. Certified copies of Gloucester County birth certificates cost $12 and are available through the Virginia Division of Vital Records (VDH). Birth records are sealed for 100 years from the date of birth; only the registrant, their immediate family members (spouse, parent, child, sibling, grandparent), or a legal guardian with proof of custody may obtain certified copies during that period, with valid identification required. Certified copies of death records also cost $12 and are restricted to immediate family or next of kin for records less than 25 years old, per Va. Code Ann. § 32.1-271. Death record requests may be submitted through the VDH’s Online Vital Records Application, in person at the local health department, or by mail to VDH, Office of Vital Records, P.O. Box 1000, Richmond, VA 23218-1000.
Gloucester County Probate Court Records
Probate jurisdiction in Gloucester County belongs entirely to the Circuit Court. The Gloucester County Circuit Court Clerk’s Office handles all probate proceedings, including the probate of wills, administration of intestate estates, and appointment of guardians and conservators. Probate records are maintained by the Circuit Court Clerk and are accessible by contacting or visiting that office.

Probate Process Overview
Before the appointment, the personal representative should obtain multiple certified copies of the death certificate, locate the original will (if one exists), identify all legal heirs with current addresses, and determine the value of assets solely in the decedent’s name. Within 30 days of qualification, the personal representative must provide notice to all heirs-at-law and identified beneficiaries under the will. Within four months of qualification, an inventory must be filed with the Gloucester County Commissioner of Accounts — William H.
