Sheriff’s Office Records
The Franklin County Sheriff’s Office also holds law enforcement records, including arrest reports, incident reports, and jail commitments. FOIA requests for Sheriff’s Office records must be submitted by mail or in person — the office does not accept fax submissions. Payment is accepted only in cash, cashier’s check, or money order.

Franklin County Civil Court Records
Civil litigation in Franklin County is divided by claim amount between the Circuit Court and the General District Court. The Circuit Court has exclusive jurisdiction over civil claims exceeding $25,000, as well as equity matters such as injunctions, land partitions, name changes, and appeals from lower courts. Searching Civil Records Online

Franklin County Family Court Records

Divorce and Marriage Records
Divorce cases are filed with and processed by the Clerk of Circuit Court. The Circuit Court holds exclusive jurisdiction over dissolution of marriage proceedings. Divorce records are maintained by the Clerk and may be requested in person or by FOIA. Records that have been on file for 25 or more years become public information; certified copies of more recent divorce records are available only to immediate family members.
The Virginia Department of Health Office of Vital Records also holds divorce records dating from 1918 onward. Certified copies cost $15.00 per certificate search, payable by check, money order, payment card, mobile pay, or cash. Requests can be submitted online, by mail, or in person at a VDH vital records office.
Marriage licenses are issued by the Clerk of Circuit Court. Informational copies of marriage records are open to the public. Certified marriage certificates, however, are restricted to immediate family members until 25 years after the event. Certified copies may also be ordered through the VDH for $15.00 per record.
Birth and Death Records
Birth and death records for Franklin County residents are maintained by the Virginia Department of Health. Records are available from 1912 to the present. Birth records become public information 100 years after the date of the event; death records become public 25 years after the event. Before that, only the subject and immediate family members may obtain certified copies. The Virginia Department of Motor Vehicles (DMV) also processes vital record applications in person. The Birth Certificate Application (DL 81) and Death Certificate Application (DL 82) are available at DMV locations for $14.00 each in person, or $15.00 by mail via VDH.
Juvenile and Domestic Relations District Court
The Juvenile and Domestic Relations District Court hears the following types of cases:

- Custody, support, parentage, and visitation disputes
- Children in need of services or supervision

Guardians may be appointed for the person only, property only, or both person and property.
