The county’s judicial system operates within the 24th Judicial Circuit and District, comprising three courts: the Campbell County Circuit Court, the Campbell County General District Court, and the Campbell County Juvenile and Domestic Relations District Court. All three courts are located at the same campus along Village Highway in Rustburg. The Clerk of the Circuit Court manages felony criminal cases, civil lawsuits, divorce proceedings, land records, probate matters, and marriage licenses, while the General District Court Clerk handles misdemeanor cases, traffic infractions, and small claims. The Juvenile and Domestic Relations Court Clerk oversees cases involving children, domestic violence, support, and custody.

Circuit Court Terms and Scheduling

The Campbell County Circuit Court holds terms beginning on the second Monday of January, March, May, July, September, and November. Grand juries convene on term day at 9:00 AM. Criminal cases are set on term day at 2:00 PM, and civil cases at 10:00 AM or by pretrial hearing.

Are Court Records Public in Campbell County?

Copy Fees Under Virginia Law

Fees for copies of court records from the Circuit Court Clerk are governed by Virginia Code § 17.1-275. Key copy fees include:

  • Copies of papers, records, or electronic records: $0.50 per page or image
  • Seal and clerk’s certificate: $2.00 (plus $0.50 for judge’s certificate if requested)
  • Microfilm copies: $0.50 per frame
  • Subpoena duces tecum preparation and issuance: $5.00

Credit and debit card payments are accepted with a convenience fee not exceeding 4% or $2.00 per transaction.

Campbell County Criminal Court Records

Criminal cases in Campbell County are split between the Circuit Court and the General District Court. The Circuit Court hears all felony cases and appeals from the lower courts. The General District Court handles misdemeanor offenses, traffic violations, and conducts preliminary hearings in felony cases to determine whether sufficient evidence exists to forward the matter to a grand jury. All cases in General District Court are heard by a judge without a jury.

Virginia State Police Criminal History Records

The Virginia State Police (VSP) is the designated custodian of criminal history records statewide. Criminal background checks can be requested through the VSP’s Civil & Applicant Records Exchange (CARE) unit. Two methods are available:

Name-Based Search (by mail):

  1. Visit the VSP’s online request form page.
  2. Select the appropriate form: SP-167 (general requests) or SP-230 (employment-related).
  3. Download, complete, and notarize the form.
  4. Include payment — $15.00 for a standard criminal history search, or $20.00 for searches that include sex offender registry information. Payment by money order or check.

Fingerprint-Based Search:

Requesters can submit a completed fingerprint card at VSP headquarters. The fee for fingerprinting is $10.00 for the initial card and $5.00 for each additional card. A photo ID is required.

Campbell County Sheriff’s Office

Campbell County Civil Court Records

Civil cases in Campbell County are heard by both the Circuit Court and the General District Court, depending on the amount in dispute. The General District Court handles civil claims up to $25,000, including landlord/tenant disputes and ordinance violations. The Small Claims Division within General District Court hears cases involving $5,000 or less; attorneys are not permitted to represent parties in small claims matters. The Circuit Court handles civil cases involving higher amounts and more complex matters such as motor vehicle accident lawsuits, injunctions, and land partition suits.

Property Records

Campbell County maintains property ownership records through the online parcel viewer, where users can search by owner name, parcel ID, or address. The Campbell County Treasurer’s Office provides online databases for real estate and personal property tax records, searchable by owner name, account number, parcel number, or street number.

Campbell County Family Court Records

The Campbell County Juvenile and Domestic Relations (J&DR) District Court handles the majority of family law matters, with the exception of divorce cases. The J&DR Court’s jurisdiction includes child custody, child support, visitation, parentage determinations, domestic violence protective orders, child abuse and neglect proceedings, juvenile delinquency, foster care reviews, termination of parental rights, and court-ordered rehabilitation. Divorce cases fall exclusively under the Circuit Court’s jurisdiction.

Confidential family court records — including juvenile delinquency, dependency, and abuse/neglect proceedings — are released only to eligible parties such as the record subject, legal representatives, and family members.

Divorce Records

Divorce cases are filed in and maintained by the Campbell County Circuit Court. The Clerk’s Office processes all divorce and separate maintenance suits, with the filing fee set at $60.00 under § 17.1-275. This fee includes a certified copy of the final decree. Marriage Records

The Circuit Court Clerk issues marriage licenses and maintains marriage records. The fee for a marriage license is $10.00, which includes the certificate, oath administration, indexing, and recording. Vital Records Through the Virginia Department of Health

Certified copies of Campbell County marriage, divorce, birth, and death certificates are also available through the Virginia Department of Health, Office of Vital Records. Eligible requesters include the record subject, immediate family members, legal guardians, and legal representatives. To request records:

Campbell County Probate Court Records

Probate matters in Campbell County fall under the jurisdiction of the Circuit Court. The Clerk of the Circuit Court handles the probating of wills, appointment of administrators, trustees, and guardians, name change petitions, and conservatorship matters. The Circuit Court also oversees adoption proceedings.
