How to Look Up a Court Case in Augusta County?

Augusta County court records can be searched online, in person at the courthouse, or requested by mail. The best approach depends on the court that handled the case and the type of information needed.

Online Search

Virginia operates two primary statewide case information systems:

  1. Circuit Court Case Information – The Online Case Information System (OCIS) provides access to civil and criminal case data from participating circuit courts, including Augusta County. Users can search by locality, party name, case number, or hearing date.

Are Court Records Public in Augusta County?

Virginia law provides broad public access to government records. Under the Virginia Freedom of Information Act (VFOIA), citizens have the right to inspect and copy public records maintained by government agencies, including the courts.   • Court records related to ongoing criminal investigations
  • Records that could reveal a witness’s identity in sensitive cases
  • Documents disclosing the identity of sexual assault victims
  • Records containing health or social service information
  • Sealed or expunged records
  • Records containing trade secrets or confidential business information
  • Mental health proceeding records
  • Records related to public safety matters where disclosure could cause harm

The Augusta County government also operates a public records request portal for submitting and tracking FOIA requests to county departments, including the Sheriff’s Office. Augusta County Criminal Court Records

Criminal cases in Augusta County are handled by both the Circuit Court and the General District Court. The Circuit Court has jurisdiction over felonies and certain misdemeanors, as well as criminal appeals from the General District Court and jury trials. The General District Court handles misdemeanors, traffic violations, and preliminary hearings in felony cases.

Virginia State Police Criminal Background Checks

The Virginia State Police (VSP) maintains the state’s central repository of criminal history records through the Central Criminal Records Exchange (CCRE). Any individual may request a Virginia criminal history record check by completing a notarized SP-167 form and mailing it with the required fee to:

The SP-167 form must be generated and printed from the VSP online form portal. Both the subject and the requester must sign and have their signatures notarized. The fee is $15.00 per name-based search. Processing takes approximately 15 business days after receipt. There is no expedited or same-day service.

Virginia employers and certain agencies may use the SP-230 form to request conviction-only data for approved purposes. Fingerprint-based state and federal searches are available for statutorily authorized agencies at a combined cost of $27.00 ($13.75 for the VSP CARE search plus $13.25 for the FBI file search).

Augusta County Civil Court Records

Civil matters in Augusta County are divided between the Circuit Court and the General District Court. The Circuit Court has general jurisdiction over civil cases of all types, including those exceeding $25,000, equity matters, appeals from the General District Court, and cases involving property titles, foreclosures, and injunctions. The General District Court handles civil claims between $4,500 and $25,000, small claims up to $5,000, and landlord-tenant disputes.

Land and Property Records

The Circuit Court Clerk’s office serves as the recorder of deeds and maintains all land records, including deeds, mortgages, deeds of trust, leases, releases, plats, judgments, and financing statements. The land records division can be reached at (540) 245-5320. Land records dating to 1745, plats from 1890, and judgment lien records from 1982 are available digitally.

Remote online access to Augusta County land records is available through the Virginia Secure Remote Access (SRA) system. SRA requires an annual subscription fee of $600 per subscriber (with additional assistants at $50 per year), a signed and notarized application, and submission of payment. Once enrolled, subscribers receive login credentials for the SRA website. More details about online access to land records are available on the county website.

Property assessment and ownership information can also be searched through the Augusta County Real Estate Records portal, maintained by the county assessor.

Augusta County Family Court Records

Family law matters in Augusta County are adjudicated by both the Circuit Court (for divorce, annulment, equitable distribution, and adoption) and the Juvenile and Domestic Relations District Court (for child custody, child support, juvenile delinquency, child abuse and neglect, domestic violence protective orders, and family offenses).

Divorce Records

Divorce decrees and related filings are maintained by the Circuit Court Clerk’s Office. Copies can be requested in person or by mail at the clerk’s office address. Circuit Court divorce cases can also be searched through the OCIS online system.

The Virginia Department of Health’s Office of Vital Records maintains divorce verifications from 1918 to the present. Eligible requestors—the individual named on the record, family members, or legal representatives—may obtain a certified copy by completing the Application for Certification of a Marriage and/or Divorce Record and submitting it with a $12.00 fee and valid photo ID to:

Marriage Records

Marriage licenses in Augusta County are issued by the Circuit Court Clerk. The clerk’s SRA system provides online access to marriage license images dating from August 1992 to the present. Copies of Augusta County marriage records since 1936 can also be obtained from the Office of Vital Records for $12.00 per certificate using the same application form referenced above. Eligible requestors include the individuals named on the record, their family members, or legal representatives.

Birth and Death Records

Although not court records, vital records are often sought in connection with family law matters. The Office of Vital Records processes requests for birth and death certificates at $12.00 per copy. Applications include the birth certificate application and the death certificate application. Only the record subject, immediate family members (parents, spouses, children, siblings, grandparents), or legal representatives may request copies.

Juvenile and Domestic Relations Records

The Juvenile and Domestic Relations District Court handles cases involving juveniles (delinquency, status offenses, child abuse and neglect) and family matters (custody, support, domestic violence). Adoption Records

Adoption proceedings are heard in the Circuit Court. Adoption records are sealed and are not available for public inspection. Access requires a court order.

Augusta County Probate Court Records

In Virginia, probate matters are handled by the Circuit Court. The Augusta County Circuit Court Clerk serves as the probate judge and is responsible for the admission of wills to probate, the appointment of executors and administrators, the recording of inventories and accountings, and the administration of estates. The Clerk’s office also handles guardianship and conservatorship filings.

Types of Probate Records Available

Records maintained by the Circuit Court Clerk in the probate context include last wills and testaments admitted to probate, letters testamentary and letters of administration, inventories of estate assets, fiduciary accountings, settlement agreements, guardianship petitions and orders, conservatorship filings, and related court orders. Most probate records are public and available for inspection once filed, though certain guardianship records involving incapacitated persons may contain restricted information.
